The data controller pursuant to Article 4(7) of Regulation (EU) 2016/679 of the European Parliament and of the Council on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (hereinafter referred to only as the “GDPR”) is GEZ spol. s r.o. Personal data shall be understood to mean any information about an identified or identifiable natural person. An identifiable natural person is a natural person who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, a network identifier or to one or more specific elements of the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person.

The controller has not appointed a Data Protection Officer.

II.
Sources and categories of personal data which are processed

1.

The controller processes personal data which you have provided to the controller or personal data which the controller has obtained as a result of your booking, enquiry or contact form on the controller’s website.

2.

The controller processes your identification and contact details and data necessary for performance of services provided.

III.
Legal basis and purpose of processing personal data

The legal basis for processing of personal data is performance of the services provided between you and the controller pursuant to Article 6(1)(b) of the GDPR, the controller’s legitimate interest in providing direct marketing (in particular for sending commercial messages and newsletters) pursuant to Article 6(1)(f) of the GDPR, your consent to processing for the purpose of providing direct marketing (in particular for sending commercial messages and newsletters) pursuant to Article 6(1)(a) GDPR in conjunction with Section 7(2) of Act No. 480/2004 Coll., on certain information society services if no order for goods or services was placed.

The purpose of processing personal data is handling of your booking, enquiry or request using the online form and exercising the rights and meeting the obligations arising from the relationship between you and the controller. These actions require personal data which are necessary for the successful processing of a booking, enquiry or request using the online form (name and address, contact details). Provision of personal data is essential for conclusion and performance of the contract or services provided. Without provision of personal data, it is not possible to conclude the given contract or for the controller to perform it, or to provide the services offered, send commercial messages and perform other marketing activities. No automatic individual decision-making within the meaning of Article 22 of the GDPR is performed by the controller.

IV.
Data retention period

1.

The controller retains personal data for the period necessary to exercise the rights and meet the obligations arising from the contractual relationship between you and the controller and to assert claims arising from this contractual relationship (for a period of 15 years from termination of the contractual relationship), for the period of time before consent to processing of personal data for marketing purposes is withdrawn, not exceeding 15 years, if such personal data are processed on the basis of consent. After expiry of the retention period, the controller shall erase the personal data.

V.
Recipients of personal data (subcontractors of the controller)

1.

Recipients of personal data are parties involved in delivery of services, execution of payments in accordance with the contract for provision of services for operation of the website and other services in connection with operation of the website as well as those parties providing marketing services.

2.

The controller does not intend to transfer personal data to a third country (non-EU country) or an international organisation.

Your rights

1.

Under the conditions determined in the GDPR, you have the right to access your personal data pursuant to Article 15 of the GDPR, the right to correction of personal data pursuant to Article 16 of the GDPR or restriction of processing pursuant to Article 18 of the GDPR, the right to erasure of personal data pursuant to Article 17 of the GDPR, the right to object to processing pursuant to Article 21 of the GDPR and the right to data portability pursuant to Article 20 of the GDPR, as well as the right to withdraw consent to processing in writing or electronically by means of request sent to the address or email address of the controller specified in Article III of these terms and conditions.

You also have the right to file a complaint with the Office for Personal Data Protection if you believe that your right to personal data protection has been violated.

VII.
Conditions for safeguarding personal data

1.

The controller declares that it has adopted all appropriate technical and organisational measures to safeguard personal data.

2.

The controller has adopted technical measures to secure data storage and storage of personal data in documentary format.

3.

The controller declares that only persons authorised by the controller have access to personal data.

VIII.
Final provisions

1.

By submitting a booking, enquiry or filling in the online form, you confirm that you are aware of the privacy policy and that you accept it in its entirety.

You agree to these terms and conditions by checking off the consent box via the online form. By checking off the consent box, you confirm that you are aware of the privacy policy and that you accept it in its entirety.

3.

The controller is entitled to change these terms and conditions. The controller will publish the new version of the privacy policy on its website and will also send the new version of the privacy policy to the email address you provided to the controller.
